no gaijin allowed...


I got this t-shirt a while back. Why? Why else? It's funny yet somewhat accurate in its sentimental expression. A place that prevent a race -- any race -- from patronizing an establishment has got some screwy racist policies which are outdated, regardless of reason. It's worse than segregation when you won't even allow someone's presence because of their physical cultural heritage. The sad thing is it's all borne out of hate and fear. I really don't want to be hated and/or feared so to any physical characteristic and yet I know it has happened to me before. I love the t-shirt. My only regret is that the printed design is not larger...

music article and commentary...

I haven't posted a news article with commentary in a long time. In fact, I used to do it on my MySpace musician page fairly often about things that caught my eye which I felt were noteworthy. Yes, lots of things in the news are noteworthy. I realize that. Many people do not realize that a person cannot buy things such as books, music, videos, etc. just because they live in a certain country- or rather because they do not live in a certain country. Policies like this actually hurt global economy more than they offer protection (against what is something I don't even wish to bother discussing). The one major flaw I see in economy is when consumers are not granted relevant rights- or worse yet, when their rights are not observed. I'm starting to encroach upon a tirade I'd rather steer clear of for now since it is something I have more than sufficiently touched upon in the past. If you're familiar with my past posts, chances are you already know what I'm hinting at. Anyway, anytime I see an article discussing the music industry it naturally catches my eye, esp. if it involves even a remote attempt to put the industry in its place- trust me, they need it. At some point, this world is going to see more global policy being implemented to some extent in various fields. I think it's a smart step in the right direction. Some people's standards are too low while others are too high. I have always felt a happy medium is a good thing to strive for since there are so few in this world, let alone in our lives. So yeah, you take an article about one thing and pretty soon you can see some basic concepts covered that can be applied to other things in life. Pretty neat, huh?

EU pushes music industry to open up online rights

EU antitrust regulators told the music industry Tuesday to move quickly and change licenses that currently restrict online music stores such as iTunes from offering the same songs for sale across Europe.

Internet music downloads in Europe lag behind those in the United States, pulling in just a fraction of revenues the record industry is losing from falling CD sales.

Part of the problem in Europe is that music rights are sold separately in each country, which has prevented Apple Inc.'s iTunes from setting up a single store to service all of Europe. Instead, it has to seek licenses from each EU member state where it wishes to sell and to set up separate national stores with different music selections.

EU Competition Commissioner Neelie Kroes said regulators' talks with the music industry mean that French collecting society SACEM and record label EMI were now willing to license their music to rights managers across Europe.

Apple has also said that it would offer music tracks to all European customers if it was able to license EU-wide rights.

"There is a clear willingness expressed by major players in the online distribution of music in Europe to tackle the many barriers which prevent consumers from fully benefiting from the opportunities that the Internet provides," she said.

She urged publishers and music copyright groups — also called collecting societies — "to move quickly to adapt their licensing solutions to the online environment," saying she would review progress.

This carries more than a hint of a threat. The European Commission told collecting societies last July to end a system of contracts that allow artists to collect payments only from an agency based in their own country.

It found the 24 European collecting societies guilty of breaking EU antitrust rules, but did not impose any fines. The collecting societies are members of CISAC, the International Confederation of Societies of Authors of Composers.

Musicians make money from their music after they register copyrights with collective rights managers. Those managers then license songs to online services, radio stations, nightclubs and other outlets.

Some artists have complained that altering current licenses could see them shortchanged and miss out on income from increased sales.

commentary...

*** this is probably the only other time i have made any attempt at international socio-political commentary. it is a reply to something posted in the china digital times (http://chinadigitaltimes.net/2008/04/my-friends-what-do-you-want-from-us/#comment-1354). i would rather not be in a position to speak of things particularly close to my heart as i don't like getting involved in situations where i have to defend those beliefs from those who disagree. i should also add that this probably should have been posted with the back-words series, but it slipped through the cracks as it is nor a blog, but rather a public posting.


i personally do not make any demands nor have any expectations of china or its people. however, it seems to me this is a world of extremes and china is living those extremes to one degree or the other. one does not need to live life to an extreme in order to be happy or successful. one can truly find contentment balanced within a happy medium. somewhere in the middle, most people, businesses, and countries find a mutually beneficial success.
i think china is a wondrous land, full of beauty. years ago, i was lucky to find friendship in a chinese girl. we have been pen pals on and off the internet for over five years and she is a very special person to me. if i could choose a future with someone, it would be with her. unfortunately, she lives in china and i live in the usa and aside from the physical distance between us, i do not feel i would have the same opportunities and freedom in china if i were to live there. unfortunately, she does not want to leave china, as she is already a long way from her family and does not want to be any further from them. i cannot blame her for feeling that way; family is very important and i have similar concerns.
is it possible china could change enough for a person such as myself to feel comfortable with living there? would i ever feel comfortable expressing my thoughts and living a life the way i choose under such a tightly controlled superpower? anything is possible, but such a change from china is not probable and it disheartens me. however, one can only hope that some day, all nations can see a little more eye to eye on level ground.

just a thought or two...

While the shops are still open homeless people just wonder around waiting till they close so that they can lay their paper mattresses outside them and sleep. The way homeless people are treat across the world is much the same. During the Great Depression many people were homeless due to no fault of their own. Sometimes that is still the case. Sometimes I wonder how it would be if ever I were to become homeless. That's why I try to help when I can- even when I haven't had an income. My mother and my great uncle also do what the can, each in their own way (she gives food and he is a minister at a homeless shelter). I know charity begins at home first, but sometimes I feel like my poverty may be a king's wealth to another, so I try to help when it doesn't absolutely break me because I, too, am usually hurting for money. I would be one of those people, silently hurting, never asking for help. To be in such a position is embarrassing enough as it is without having to as for help as well...

of consumer frustrations with a favored product...
Who has a favorite product? Chances are that we all have at least one. Chances also are that at least one of our favorite products have become hard to find or even discontinued. If it starts to happen to you too many times you might feel a little frustrated as a result. The following is a letter I sent to Downy because I can no longer find a product they declare is not discontinued and should be found at any of my local stores. What transpires of this is yet to be known, but I thought I would share my experience thus far...

Citrus & Light™ Ultra Downy® with Febreze® Fresh Scent-
This is possibly one of the best products Downy has ever released. My family has used Downy for generations beginning with my grandmother. Now I use it, too. However, being a male, I prefer something a little more masculine which is why I prefer the Citrus & Light scent.

Unfortunately in recent months I cannot find it anywhere anymore- not at my usual grocery stores (Giant, Safeway, Harris Teeter) nor at places such as Target, KMart, or WalMart. I cannot even find a way to purchase it online. What is the situation? Your Q&A section does not specify Citrus & Light as being discontinued, only "compacted." The product line area of your site does not indicate anything is discontinued at all. I find the lack of continuity distressing.

About a month ago, I tried to acquire a coupon for Downy on your site, but it was for a specific line I had no interest in. Shouldn't I, the consumer, be allowed to choose which style of Downy I choose to apply a coupon toward? It's a little misleading to offer a coupon toward downy and then realize it is toward only one specific style or type.

The lack of continuity between shapes, sizes, and opaqueness of bottle is also disconcerting- it becomes difficult to search for things if they do not mark a basic commonality. Downy's effort to shake things up to look fresh, new, exciting, and different fails- and this is coming from a multi-generational family user. I'm sure opinions and concerns from a user with a background such as mine bares more heft. As I say, I love the product; I am just dismayed at how Downy has been handling things as of late.

Additionally, I do not see a point in making multi-lingual product labeling. As your company has specified, this product is for North American users- not South American, not Central American, nor others. While the Unites States in particular may be a massive multicultural melting pot, our national language is still English and we should encourage all new-comers to this great country to learn its national language if they haven't already. Downy should realize English is a major international language being learned and used world-wide, especially for business. With foreign countries actively searching and hiring native English-speaking teachers to teach the language, it would seem that Downy, a North American company, would choose to sell a North American product in North America in its native tongue, English. All the extra translations do is clutter up the packaging and aside from that Downy is pretty easy to use- one doesn't even need pictographs; one capful for one load and it can either be tossed in during the rinse or a Downy ball can be used, which is what I do.

The Downy ball really eliminates the hassle of an extra step in my laundry process, which saves me time to get other things done. Clearly I love the product and the convenience it adds to my life, so why why not make things easier for longterm users such as myself by making the bottles easier to buy, find, and read?

I really would like to buy some Citrus & Light™ Ultra Downy® with Febreze® Fresh Scent, but I just can't seem to find it anymore. I can't adequately describe what a frustrating experience that is. Surely many of the individuals who comprise Downy have endured similar situations with being unable to find favorite products.

Additionally of note, I am aware my little tirade may not be received with open arms, but is it not the desire of a company to please existing customers and not to lose them in the hopes of acquiring potentially new customers? If there are multiple departments within Downy as I suspect there are, it would be my wish to have my letter forwarded to as many of those departments as possible so that they may gain the perspective of an existing customer with a longterm multi-generational consumer commitment such as mine. Otherwise, it would seem my thoughts are merely in the rinse. Thank you for your time and consideration. I remain in hopes you can shed some light on where I can purchase more Citrus & Light™ Ultra Downy® with Febreze® Fresh Scent.

more thoughts...
i have a close friend who lives in another country overseas. we talk regularly about different things so that we can learn more about each other and our cultures. i like gaining a better understanding; i think it improves our relationship. i think gaining a better understanding in general can promote better relationships with all ppl, which leads me to the point of this entry: today she was asking me what i thought about iraq and afghanistan, but i feel she also wanted to know my views on war and conflict, in general...

this was my reply:

i wish everyone could get along...

in the 70s, there was an old coke-a-cola commercial that featured some hippies singing: "i would like to teach the world to sing in perfect harmony..." the point they were trying to make was that there would be harmony if everyone could learn to simply work together. i do not think that is an impossible notion as long as ppl are willing to try.

now, what does the world do when not only someone is not willing to try to get along with everyone else, but also is doing things to hurt ppl and they wont stop? do you turn away and let them continue to do something bad or do you stand up and try to help? while i may not support war, i also do not support letting ppl get away with doing bad things that hurt other ppl.

you can say "stop it!" but most ppl will not obey. sometimes you have to make a person stop. that is why there are parents, teachers, police, and even military... this world has seen many mean ppl who would not stop what they were doing, many very bad ppl, and virtually every time this country has had to help. this country has come to be know as the police of the world, which isnt such a bad thing- at least ppl know theres someone out there who will do something about what is wrong. has this country always handled every situation perfectly? no, not really, but least theyre trying to get something done about it and they dont give up trying to help. i think that is important to keep in mind.

now, im not having a persuasive argument. im not pushing my point of view on anyone. this is not something i am willing to debate as i rarely even voice my opinion about such things since ppl tend to get way too personal in such discussions, so please, take your flame war somewhere else. if you disagree with me, write about it on your own blog- not mine. thank you...

as one can probably guess i could have gone on further in my reply. i could have even tried to ensure that my point was not only valid, but correct via persuasive debating. as it was, i did make some concessions. nothing in this world is perfect, but i think it is worth the effort to try to make things better than what they are if we see something bad happening. in the past i have heard of ppl practicing "in the eyes of a child," which means, asking a child for their opinion of something. usually the reply can be quite eye-opening. i think if we can maintain a portion of that frame of mind we can be more at peace with ourselves when we wish to solve difficult situations. would you let a bunch of thugs beat on a little old lady? no, you would try to help. why would it be any different if that bunch of thugs were nazis or an entire of country? the answer is it really wouldnt be any different. you would still try to help in any way possible. sometimes it isnt the best way possible, but you still have to try and you can always sit around and discuss an issue til youre blue in the face, but a perfect resolution may never be reached and in the the time that has transpired without action, a lot of harm could have been done. that wouldnt weigh very well on the conscience would it? no, it wouldnt feel good at all. we all need to try to understand that we are all trying for the benefit of a cause. we all need to try to understand each other so that we all can get along better, and by "we all" i mean every single one of us in this world. just try- its not hard to do. dont be afraid, just try...

yet another year has come to pass...

...and a new one is just taking shape.

not only is it a new year, but it's also the dawn of a new presidential term. we will see how that works out. personally, i'm not holding my breath; no individual alone can save a nation and i think the country maintains a focal point on the presidential position that is perhaps overwhelmingly unfair. i am not in favor of the current man holding this position, but i also don't think he should be scapegoated in the face of overwhelming failure. after all, many factors are involved in civic actions.

aside from the political rigmarole, i'm already seeing changes taking place in my life this year and i hope the momentum continues. i've been studying japanese on my own for a good part of last year and i already am coming to understand words, phrases, and characters. i listen to japanese as much as possible hoping to train my ear to the language. it's a difficult language, but i really would like to be fluent. maybe some dreams can be reached...

my financial situation is starting to look up and if i keep handling things well, then life's unattainable necessities will soon no longer feel like such a burden. this year should bring the onset of financial stability, which is something i have been hoping for all along. all i have to do is play my cards right and mainly be patient. the downside is i didn't want to achieve this as a result of a family member preparing to pass away. because of that, i will be sure to make the best use of these finances since it is thanks to my grandfather that i have them.

speaking of my grandfather, i mentioned we nearly lost him two weeks after my grandmother's passing last year. something similar happened again in december and i am aware his health is such that he may not see this year through, so i have been going to see him during each holiday since thanksgiving in hopes that he will realize he is not alone or forgotten. i wish the rest of my family would do the same, but it hasn't been on everyone's agenda, much to my dismay. i think my family was fortunate to be there when my grandmother passed. I don't think they will have the same fortune when it is my grandfather's turn. hence, i am concerned that he should be reminded how we feel so he has no doubts.

this month i scratched my other cornea and recuperation has been excruciating, yet nowhere near as bad as the first time with the other eye. i think this cements the idea that i won't be making a living as a fine detail artist as once planned. however, i feel that shouldn't probibit me from working on music, teaching, writing or whatever else i wish to set my mind toward doing. even if my eyes get worse and they still aren't surgically correctable, i still want to forge a way for myself following a passion rather than presuming im useless and only good for something such as basket weaving. the other day i heard that man can be destroyed, but cannot be defeated and i am inclined to agree with that. no matter what obstacles cross my path or change the course of my future, i want to find a way to always persist regardless of the odds.

while i'm thinking about it, i want to convert this blog into a central repository via transferring my other blog entries to this blog. i won't be deleting the other blogs, but i think it would be nice if everything could be read from on place rather than navigating to multiple locations. in that way, this blog will truly feature all facets of my life- or at least as much as i choose to post. i may make an effort to retain original post dates to those blogs so as not to create any confusion with what is currently transpiring in my life. i hope you will enjoy those entries as i bring them over bit by bit (it's quite a lot actually).
